Intelligent Fitness, LLC – Waiver and Release of Liability

Before participating in any personal training, virtual session, or at-home exercise program, please read and acknowledge each section below. By signing at the bottom, you agree to the terms outlined in this agreement.

1. Assumption of Risk

I acknowledge and agree that:

  • I voluntarily choose to participate in physical exercise and training activities, including in-person, virtual, and at-home programs.

  • I understand that all exercise carries inherent risks, including but not limited to injury, illness, or property damage.

  • I assume full responsibility for any risks associated with unsupervised, at-home exercise.

  • I confirm that I have a safe and appropriate space to participate in exercise activities.

  • I certify that I am medically able to participate in exercise or have consulted with a physician prior to beginning.

2. Release of Liability

I, on behalf of myself, my heirs, executors, administrators, successors, and assigns, hereby release and discharge Intelligent Fitness, LLC and Danielle Wirick, including their owners, employees, contractors, agents, representatives, affiliates, successors, and assigns (collectively, the “Released Parties”), from any and all claims, liabilities, or causes of action arising out of or related to my participation in training services, including those arising from the negligence (whether active or passive) of the Released Parties, to the fullest extent permitted by law.

This release includes, but is not limited to, any injury, loss, or damage resulting from:

  • Use or misuse of exercise equipment or facilities

  • Improper maintenance of equipment or facilities

  • Instruction, supervision, or training services

  • Slipping, tripping, or falling on premises or while traveling to/from sessions

  • Participation in virtual or unsupervised, at-home exercise

3. Indemnification

I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, damages, losses, liabilities, costs, or expenses (including reasonable attorney’s fees) arising out of or related to my participation in training services.

4. Acknowledgments

I acknowledge and agree that:

  • This agreement is intended to be as broad and inclusive as permitted by the laws of the state in which services are provided.

  • If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

  • Intelligent Fitness, LLC and Danielle Wirick provide training services and are not in the business of manufacturing or selling exercise equipment; any equipment use is incidental to the services provided.

  • This agreement does not waive or release claims arising from gross negligence or intentional misconduct.

  • I have carefully read this agreement, fully understand its contents, and understand that I am giving up certain legal rights by signing it.
